Canada Targets Employers Violating Temporary Foreign Worker Program Rules

โœ…Canada is intensifying efforts to penalize employers who violate the Temporary Foreign Worker Program (TFWP) rules, issuing $2.7 million in fines last year against 194 non-compliant employers. Some have also been suspended from hiring temporary foreign workers to protect newcomers from exploitation. Under TFWP, employers must adhere to strict obligations, including meeting requirements of the Labour Market Impact Assessment (LMIA), terms of the LMIA decision letter, and Immigration and Refugee Protection Regulations (IRPR). They must keep relevant records for six years and immediately report any changes to Immigration, Refugees and Citizenship Canada (IRCC), including changes in worker conditions or LMIA errors. Canada overhauls Temporary Foreign Worker Program, prioritizing agriculture and worker protections

โœ…Canada intends to simplify and update its Temporary Foreign Worker Program (TFWP) next year, with a focus on adding more agriculture and food processing jobs. The revised program aims to provide better protections for migrant workers, including allowing them to change employers within the same industry to avoid exploitation. Trusted employers with a clean record may receive two-year work permits. The proposed changes streamline the program by reducing four streams to two and address industry-specific shortages. The overhaul follows concerns about worker exploitation and criticism from international bodies. The transition to the new system will be gradual, with full implementation expected by 2027, accompanied by consultations with stakeholders. The Federal Court of Canada Denied Work Permits Due To Concerns Over Language Proficiency

โœ…Recent cases in the Federal Court of Canada highlight the importance of language proficiency in work permit applications. In the first case, an applicant was denied a permit to work as a Construction Project Coordinator despite having no language requirement for the position. In the second case, a farm worker's application was refused due to language concerns, even though the job had no formal education requirements. The court overturned these decisions, emphasizing the need to provide strong evidence of language proficiency, even when not explicitly mentioned as a prerequisite in the job description. This emphasizes the significance of language skills in Canadian work permit applications. . .
